Lawyer Discusses Role of Property Owner in Car Accidents

While this particular case was a bit convoluted to begin with, it apparently started with a broken water main to a business owner’s land; a break that was not spotted until later in the day, when the damage had already been done to several cars that spun out on the black ice this break created in response to freezing temperatures.
“There were at least three wrecks, with one sending a woman straight into a concrete wall. The woman needed surgery and remains in critical condition. Two other vehicles overturned. The scene was a complete mess of black ice and invisible water on the surface. Ideal conditions for car accidents,” Donahue said.
The unfortunate part about this circus was that the police first notified the Department of Transport that there was a problem very early in the morning, right after the first two accidents. The source of the water main break was not located until later in the day and the water shut off to allow repairs to get underway.
Interestingly, the owner of the land in this case was told the break was on his side of the main and that he would not get his water turned back on until he upgraded his pipes. The land and business owner disputes the break is on his side. This may yet turn out to be a standoff between the local water utility, the Department of Transport, the landowner and at least one seriously injured plaintiff who may wish to seek compensation for her surgery and medical bills, etc.
Of even more interest perhaps is the role that the landowner will play in terms of being responsible for the car accidents that took place as a result of his broken water main. This will no doubt involve the question of whether or not he was aware of the situation and did nothing to fix it.
