Lawyer Says Couples Should Steer Clear of Social Networking During Divorce Proceedings
Mar 30, 2011
Orange County, CA (Law Firm Newswire) March 30, 2011 – Close to 81 percent of divorce lawyers have seen their clients use or bring in social media evidence in their divorce, the American Association of Matrimonial Lawyers found in a recent study. But even if an individual has the urge to use Facebook, Twitter, or other sites to tell the world about how much they hate their soon-to-be-ex spouse or are excited to be divorced, tread very carefully.
Any pictures, messages, or videos could be used against an individual during the divorce settlement negotiations. Many lawyers advise clients to stop using social media, or at least not post anything about the divorce. Otherwise, an individual risks losing child custody, property or assets, and could face a nasty courtroom battle. It is also wise to know who has access to a profile page and passwords. Change passwords, if necessary, and be sure to modify security settings as programs get updated.“You never know when a mutual friend might tell your spouse what you said about your kids, the divorce or how you want to go party every night,” said Gerald Maggio, an Orange County divorce lawyer at the Maggio Law Firm. “What could be a more amicable divorce will turn ugly if you go wild on social media sites. Save yourself financial and emotional stress and stay off the social networks.”
Previous divorce cases highlight the need to stay away from e-mail and social network blasts. Posting photos about an exotic trip while saying there are not enough funds for spousal maintenance payments will not go over well. Letting friends on your Facebook wall know that you want to go on a drinking or drug binge will be used as ammunition against your credibility.
“Lots of people use the Internet and social sites for support,” Maggio said. “But in the end, you are better off saving those conversations for when you are together with family and friends. Keep thinking about protecting yourself from any questionable activities to have a successful divorce.”
