Veterans Who Retired From Military for Medical Reasons Have Second Chance for Better Benefits

Northville, MI (Law Firm Newswire) October 21, 2011 – In the latest review by the U.S. Military Physical Disability Board of Review (PDBR), more than 50 percent of veterans who were re-evaluated became eligible for a disability retirement. The PDBR currently allows veterans who separated from the military between September 11, 2001 and December 31, 2009 for medical reasons to have their file checked for fairness and accuracy.
“The PDBR looks at the Medical Evaluation Board and Physical Evaluation Board disability ratings to see if a correct disability retirement assessment was done,” said Veterans disability lawyer Jim Fausone. “If you are awarded at this stage, you will get monthly disability retirement pay retroactive to the time you originally separated due to the disability.”
Of special note, veterans who have a disability of 20 percent or less and did not receive disability retirement can have their claim reviewed. So can former reserve members who have more than 20 years of federal military service but less than that amount of active duty. Successful claims will also become eligible for TRICARE health care coverage and a survivor’s benefit plan insurance.
“Some of your previous medical bills could be retroactively reimbursed by TRICARE,” said Fausone. “With the success rate of the PDBR claims, your case is worth looking at if you have a disability rating.”
The PDBR reviews each case and makes recommendations to the appropriate Veteran’s Military Department Decision Authority. An estimated 70,000 veterans are eligible for this type of review, but only about three percent have applied.
“As the word gets out about this newer program, a veteran should be proactive to have their claim filed,” said Fausone. “We will assist you to have a complete application, strong supportive documents, and a clear history of your military record.”
