Cyclist Run Over by Fire Truck Reports Michigan Litigation Funding Corporation
Dec 27, 2011
Southfield, MI (Law Firm Newswire) December 20, 2011 – This is a disturbing accident case involving a teen on a bike with no brakes and a fire truck. The fire truck ran over the teen.
“We’ve seen a lot of cases over the years of providing litigation funding to various plaintiffs,” remarked Darren Monroe of Litigation Funding Corporation, Michigan. “But we’ve not often seen speculation that the biker may have caused his own death. We feel that may well be open for speculation and that his family may elect to file a wrongful death lawsuit.”
This accident happened in Winter Park, Florida and the teenager was killed when his bike crashed into the back of a fire truck. It seems, according to eyewitnesses, that the fire engine and the cyclist were heading in the same direction. The bike was riding next to the engine on the passenger’s side of the vehicle. When the fire truck started to make a left hand turn, the cyclist was hit and was trapped under the engine’s wheels. Although the young teen made it to hospital, he died later.
According to the fire department, the young man lost control of his bike, fell and slid underneath the engine. The fire engine, in motion at the time, ran over him. The driver stopped immediately, and although he did not stop the truck on top of the teen, the boy was partially under the engine when it did stop. Police investigators discovered that although the teen had tried to avoid colliding with the truck, he could not, as it looked like the bike did not have brakes, meaning that a collision was virtually inevitable.
The troubling thing about this accident is that the investigators are saying the young man did not obey traffic laws at the time and therefore caused the accident, not only by riding a bike without brakes, but by not obeying traffic laws. In other words, they were speculating that the accident was no one’s fault but the bikers.
“We suspect that his family will likely contact a personal injury attorney and discuss a wrongful death lawsuit, despite what the investigation indicated. There is more than one way to look at an accident scene, and for all they know, that bike may have been defective,” suggested Monroe.
No matter what choices the family makes with regard to filing a lawsuit, if they need financial assistance to make it through until a verdict or settlement, they have the option of applying for litigation funding, providing they do have a lawyer working for them. All they need to do is fill out an online form, have their case checked and it if is approved, the plaintiff receives their lawsuit loan within 24 to 28 hours. It is deposited directly to their bank account.
Typically, when plaintiffs have their financial issues tucked out of the way, they have the time and the money thanks to pre-settlement funding, to let justice take its course. This also means they do not have to deal with insurance companies. While litigation funding is not for everyone, it may be just right for others. “If you are facing a trial for a personal injury lawsuit, why not call or visit our litigation funding website and find out more about how it works,” suggested Monroe.
