Jackknifed Truck Collides Into Dump Truck Causing Fatal Accident Reports Atlanta Personal Injury Lawyer
Dec 4, 2011
Atlanta, GA (Law Firm Newswire) November 30, 2011 – Two big rigs getting into an accident occurs more often than one might think. This reported accident killed a trucker.
“It was a strange sort of accident, that no one saw coming. It happened in the blink of an eye,” said Stephen Ozcomert, an Atlanta injury lawyer who practices personal injury, accidents and malpractice law. “The trucker happened to be in the wrong place at the wrong time and although he made it to the hospital alive, after being taken out of the truck with the jaws of life, he died shortly afterwards.”
The trucker was driving a dump truck south on the highway when around the curve came a northbound empty tractor-trailer. When the tractor-trailer hit the crest of the sharp curve it tipped sideways, jackknifed, and sheared a pin holding it to the tractor. The trailer rammed into the dump truck, crushing the cab. It would have been a miracle if the dump truck driver had lived to tell the story of this accident.
According to the police report, there is no evidence why the trailer jackknifed given that the road conditions appeared to be clear and dry at the time of the accident. “This would leave the investigators wondering if the tractor-trailer trucker was driving while distracted, texting, on the phone, fiddling with a GPS, reaching for something on the floor or dozing off behind the wheel,” Ozcomert indicated.
Trucking accident cases like this typically end up in court as wrongful death lawsuits, especially given the nature of the details of the case. Not all of them are the same, but there are some things that all trucking accidents do have in common, and “those details are that there is rarely just one defendant named in a wrongful death lawsuit involving a big rig,” said Ozcomert. “This is due to the fact that unless the trucker outright owned the rig and drove independently, he would be employed by a company who could be vicariously liable for the actions of their employee,” explained Atlanta personal injury lawyer Ozcomert.
In most of the trucking accident cases there is a large amount of insurance money on the table, and that means the plaintiff’s counsel needs to deal with the defendant’s lawyers and the trucking company lawyers. “It can often be a three-ring circus, but it’s something that needs to be done to get justice for the accident victim and/or their family,” added Ozcomert.
