Florida Courts Push Through Backlog of Foreclosure Cases

Brandon, FL (Law Firm Newswire) January 25, 2012 – If the housing market is not going to recover until the foreclosure backlog is absorbed, then it might be good news that lenders sent out notices to foreclose on almost 11,000 Florida homes in October – an 11-month high.
The Miami area had the most with 4,193 and Tampa Bay and Orlando-Kissimmee each had more than 1,000, according to a RealtyTrac report.
The Tampa Bay Times reported that bankruptcy filings were down most of 2011 and the Tampa Bay area’s filings were down 59 percent from a peak in October or 2010.
“Florida’s mortgage crisis still doesn’t appear to be letting up,” said Brandon bankruptcy attorney Reginald Osenton. “The courts are stuffed with foreclosures.”
The paper reported that foreclosures are coming in waves in Florida because three large law firms collapsed in fall of 2010. The David J. Stern Law Firm abandoned about 100,000 foreclosure cases across the state in March of 2011. As the courts go through all of these cases to alleviate the backlog, the number of filings are fluctuating from month-to-month.

Another result of the mess created by law firm collapses is the state’s mediation program has struggled to be successful. The Florida Supreme Court created the program to help keep people in their homes by negotiating with banks to restructure their mortgage.
