Man Never Should Have Survived This Brutal Trucking Accident Says Atlanta Personal Injury Lawyer
Feb 10, 2012
Atlanta, GA (Law Firm Newswire) February 9, 2012 – Being flattened by a tractor-trailer typically does not guarantee one survives. This man did.
“I’ve seen a lot of big rig accidents during the course of my practice,” said Stephen Ozcomert, an Atlanta injury lawyer who practices personal injury, accidents and malpractice law. “I have helped many plaintiffs go to court to recover for their serious injuries. The man in this reported case should not even be alive today. It was that horrific.”
The man was waiting at a red light when the trailer portion of a tractor-trailer pulled away from the rig and careened into the man’s Silverado truck. The results defy description, other than to say the truck was completely flattened leaving the man trapped inside the wreckage. It took over an hour and a half before EMS crews could pull him out, a herculean feat that required them to lift the trailer off the Silverado, and then cut open its top.
The 60-year-old was rushed to the nearest hospital with a broken neck and wrist, bone fractures and spinal fluid leaking into his body, not to mention nerve damage in his right wrist and arm. It was a true miracle that he made it out of this accident alive; seriously hurt, but alive.
The man and his wife filed a personal injury lawsuit against the truck driver and his company, in which they stated the trucker was driving recklessly. Evidence revealed the brakes on the rear trailer had slammed into the man’s vehicle were not adjusted properly and were mismatched. The case was eventually settled out of court about a year later for $1.4 million and the driver was fired.
Trucking accidents are not like the usual car accidents that people either see or are involved in. They typically end with serious, life-altering injuries or death, and there does not seem to be anything in between, other than a great deal of pain and agony. “Aside from the mechanical issues that contributed to this accident, the trucker was cited for careless driving and making an improper turn; so really, there was more going on that caused the accident,” remarked Ozcomert.
The simple fact here is that trailers should not tip over on to the roofs of other vehicles. “Unfortunately, things like this do happen, and someone inevitably pays the price, and while this particular accident may have been unusual, accidents involving big rigs are not. In any instance where you may have been involved in an accident with a big rig, always call a veteran Atlanta injury lawyer and find out what you can do to recover damages,” urged Ozcomert.
