Attorneys Hamill and Hoey file suit against Cape Cod MA. Nursing Home

Boston, MA. (Law Firm Newswire) June 26, 2012 – Attorneys David Hoey and Bernard J. Hamill recently joined as co-counsel to file a civil wrongful death lawsuit in the Barnstable County, Massachusetts superior court on behalf of the Estate of John Miller against Eagle Pond nursing home. Miller was allegedly fatally injured by a fall at the Cape Cod nursing facility on June 16, 2010. Miller was a resident of Eagle Pond nursing home in Dennis, Massachusetts. Kindred Nursing Centers East, LLC d/b/a Eagle Pond Rehabilitation & Living Center is a member of the Kindred chain of long term care nursing facilities.
According to the complaint (Barnstable county docket # BACV2012-00027) filed by attorney Hoey, Miller was allegedly injured “when staff members dropped him from a hoyer lift while attempting to transfer him. Miller allegedly suffered irreversible “brain damage as a result of being dropped” according to the suit.
The suit claims that Kindred Nursing Centers East, LLC D/B/A Eagle Pond nursing home acted negligently in its care for Miller in that Eagle Pond nursing home and “failed to take necessary and appropriate actions to provide adequate safety measures; failed to provide a safe environment for Mr. Miller; failed to properly administer and manage Eagle Pond facility such that it operated in violation of safety rules, physician orders, policies, procedures, state and federal regulations, care plans, and thereby placed John Miller at risk to sustain injury, and did in fact cause injury; and failed to provide equipment that was safe and in good working order.”
According to the complaint filed: “Miller suffered extensive head wounds and died shortly after as a direct result of the fall at Eagle Pond.”
