Charter Bus Kills Cyclist
Mar 12, 2013
Southfield, MI (Law Firm Newswire) March 11, 2013 – A bus driver, following a cyclist too closely, struck and killed him.
“A 77-year-old charter bus driver struck and killed a local county pastor, out for a bicycle ride. Initial reports indicate the driver did not see the cyclist, although there is some question as to whether or not the driver was following the cyclist too closely, which caused the accident,” explained Darren Monroe of Litigation Funding Corporation, Michigan.
The charter driver was charged with following too close and second degree vehicular homicide. Despite the fact that there was no intention on the part of the bus driver to commit this kind of deed, he is considered to have been negligent in the performance of his duties in driving his bus. He is tasked with driving with due care and attention, not an unwarranted expectation, given that he took hundreds of passengers on charter trips every year.
In this instance, although the driver said he did not see the Pastor, there will be questions about whether or not the driver may have been texting while driving or was otherwise distracted while behind the wheel, or if he was under the influence of something at the time, or perhaps speeding. Age may also play a factor in this accident, as at 77-years-old, the driver’s reflexes may not have been as sharp as they once were.
This incident may well result in a wrongful death lawsuit, if not criminal charges. The Pastor’s family may wish to discuss the accident with a personal injury lawyer, to understand their options and seek compensation from the court for his loss. “It is likely the family would hope to also make the point that if you have care and control of a large vehicle, such as a bus, then extra care needs to be taken while driving,” added Monroe.
Faced with needing to pay their usual financial obligations and then unexpected funeral and burial costs, the Pastor’s family may wish to consider applying for a lawsuit loan from a litigation funding company. They just need to call and talk to someone about the case. Pre-settlement funding is an emergency loan that is approved for qualified plaintiffs, that lets them get back on their feet financially while waiting for a settlement or trial.
“Litigation funding is not for everyone,” stated Monroe, “but it has many benefits for a plaintiff, not the least of which is if the plaintiff loses the case in court, they keep the money, free and clear.”
