Dad Kills Three Year Old Son In Drunk Wreck
Apr 16, 2013
Austin, TX (Law Firm Newswire) April 15, 2013 – Drinking and driving is never a good idea. Driving with a small child in the car can be fatal.
“You’d think that with all the drunk driving education around today that people would not drink and drive, and would certainly not, if they chose to ignore the warnings, drive while inebriated with a small child in the vehicle. The 33-year-old father in this case not only chose to drive while three sheets to the wind, but had two passengers in his vehicle as well. One was a 22-year-old woman and the other was his 3-year-old son,” said Brooks Schuelke, an Austin personal injury lawyer with Perlmutter & Schuelke, L.L.P.
Police reports indicated that the man was heading east on the highway when he lost control of his car. It immediately veered into the path of an SUV, and at the same time, a third vehicle slammed into the back of the SUV. Killed in the wreck was the man’s son. The 22-year old woman was airlifted to hospital and listed in critical condition.
The rest of the survivors were taken to local hospitals for medical treatment and all three drivers were given breathalyzer tests. The father failed his sobriety test and police charged him with involuntary manslaughter, failure to drive on the right side of the road and assault. Despite the fact that all those involved in this deadly accident were wearing seat belts, the force of the impact was too great for belts to help the 3-year-old.
“As it turned out, the father has a prior record for drunken driving and had an up close and personal encounter with two other cars last year when he was driving under the influence. That accident landed him in hospital with serious injuries. He was also arrested by the police on an outstanding warrant for not paying child support,” Schuelke related.
Serious injury accidents like this one often involve a wrongful death, and when there is clear negligence present, it serves to inform a judge and jury that the defendant was acting in a careless and reckless manner. “A case like this would stand a good chance of succeeding in court as either a wrongful death lawsuit on behalf of the young boy or a personal injury lawsuit on behalf of the seriously injured female,” explained Schuelke. “In either case, it is vitally important to reach out to a skilled injury lawyer and find out what your legal rights are and what could transpire should a case go to court.”
