Man Faces Up To 20 Years In Prison If Convicted Of Intoxication Manslaughter

The man made it to hospital alive, where he later died as a result of his significant injuries. The accident happened in August of 2010.

Eye witnesses to the crash described dark colored Toyota as the vehicle that struck the biker. Police later found the vehicle and arrested the driver, who attempted to enter a guilty plea to the charge of intoxication manslaughter. However, the judge rejected the driver’s plea and issued an order for him to stand trial.

In September, 2012, the alleged drunk driver was arrested once again as he was sitting outside the county courthouse, waiting for a bond hearing. He was arrested on an outstanding warrant for vehicular intoxication manslaughter. The driver had been ordered to appear in court again at the behest of the attorney general’s office. They indicated the original bond on the manslaughter charge was set too low. The original bond posted was $50,000.

After posting the original bond and being released, the driver moved to Harrison County and became embroiled in an argument with his girlfriend. She called police after reportedly being attacked with an assault rifle. The man was also arrested on an aggravated assault warrant.

“Evidently the man had a history of running afoul of the law in a number of ways,” said Lee. “However, on the motorcycle hit-and-run case, he may well face up to 20-years in state prison if he is convicted of the death of the biker. Certainly it is apparent there is negligence involved in the case —- negligence in drinking to excess and negligence in driving while under the influence.”
