Man Faces Up To 20 Years In Prison If Convicted Of Intoxication Manslaughter
Sep 6, 2013
Austin, TX (Law Firm Newswire) September 5, 2013 – This hit-and-run collision killed a biker.
“This reported case was particularly horrid, as the drunk driver who caused the accident fled the scene, leaving a 47-year-old man lying in the tangled mess of his motorcycle,” stated Bobby Lee, an Austin injury lawyer of Lee, Gober & Reyna. The man made it to hospital alive, where he later died as a result of his significant injuries. The accident happened in August of 2010.
Eye witnesses to the crash described dark colored Toyota as the vehicle that struck the biker. Police later found the vehicle and arrested the driver, who attempted to enter a guilty plea to the charge of intoxication manslaughter. However, the judge rejected the driver’s plea and issued an order for him to stand trial.
In September, 2012, the alleged drunk driver was arrested once again as he was sitting outside the county courthouse, waiting for a bond hearing. He was arrested on an outstanding warrant for vehicular intoxication manslaughter. The driver had been ordered to appear in court again at the behest of the attorney general’s office. They indicated the original bond on the manslaughter charge was set too low. The original bond posted was $50,000.
After posting the original bond and being released, the driver moved to Harrison County and became embroiled in an argument with his girlfriend. She called police after reportedly being attacked with an assault rifle. The man was also arrested on an aggravated assault warrant.
“Evidently the man had a history of running afoul of the law in a number of ways,” said Lee. “However, on the motorcycle hit-and-run case, he may well face up to 20-years in state prison if he is convicted of the death of the biker. Certainly it is apparent there is negligence involved in the case —- negligence in drinking to excess and negligence in driving while under the influence.”
For those who have been in an accident with a suspected drunk driver, it is imperative to contact an experienced Austin injury lawyer. Their job is to assist victims to obtain fair and reasonable compensation for their injuries sustained in an accident caused by someone else’s negligence.

- Texting-while-driving restrictions need to apply to all ages across the board
It’s not just teenagers that text and drive. Adults do it too. In fact, most teens see their parents do it and rather than listen to what their parents say, they do what they see them doing instead. The results are deadly. The National Highway Traffic Safety Administration (NHTSA) statistics indicate that texting while driving is six times more dangerous than DWI/DUI. Texting involves taking your eyes off the road for an average of 4.6 seconds, and while that may not seem like a long time, it is long enough to cover the full length of a football field, as […] - Driving while “intexticated” is a serious issue for everyone
One young Texas man is lucky to still be alive today after spending six long months in hospital, due to texting while driving. Fortuitously, the man’s name is Chance; he got a second chance at life after a horrific accident where the engine of his truck landed in his lap after he plummeted into a ravine. He was pulled from the truck just before it burst into flames. Just prior to his crash, Chance was texting a friend. His last words were that it was dumb to be texting while driving and that if he kept doing it, he would […] - Motorcycle riders should not be put on trial if an accident was not their fault
Motorcycle riders are often regarded as second-class citizens on the road by other drivers, despite the fact that they have every right to be on the same road as cars and other vehicles. More often than not, any accident involved a biker and another vehicle was not the fault of the motorcycle driver. Usually, any accident was the result of a vehicle turning into the path of the biker. With nowhere else to go but into the side of the vehicle, accidents like this often seriously injure or kill the biker. And yet, if a case goes to trial, it […] - Alleged drunk driving causes a fatal accident
In a distressing case, two brothers went out for the night, and reportedly had several drinks. One of the brothers at some point got behind the wheel of his Pontiac Grand Am, with his brother in the passenger seat. The driver may have been intoxicated. Shortly after the two brothers headed home, the 32-year-old driver lost control of his vehicle and hit a tree. The force of the collision resulted in the car flipping over and landing on its roof. In the process, the 37-year-old passenger, the driver’s brother, sustained serious internal injuries. He was taken to hospital and hooked […] - Some big rig under-ride guards are not effective in certain kinds of crashes
Big rigs have under-ride guards to prevent cars from sliding under them during a crash. Some guards are ineffective. If you travel on the highways a fair amount, you may find yourself involved in a collision with a semi-truck. It could happen in the blink of an eye, during a moment of inattention or as a result of road conditions. No matter what the cause, if you slam into the rear end of a big rig, the consequences may be deadly. In the hopes of reducing deaths as a result of vehicles sliding under 18-wheelers, the trucking industry created and […]
