Teen Dead, Four Injured at Unsafe Clermont County Intersection
Jan 22, 2015
Austin, TX (Law Firm Newswire) January 22, 2015 – Texas counties are not alone in dealing with poor road construction and unsafe conditions.
“This Ohio accident could easily have happened outside of Austin or on one of the bypass roads that circle the city,” said Brooks Schuelke, a personal injury attorney with Perlmutter & Schuelke, LLP. Dangerous intersections can be found in every town, city and metropolis across the nation. Unfortunately, many people find out the hard way that speeding and unsafe road conditions can result in serious and even deadly accidents.
A 19-year-old teen was killed in the October 19 collision. His mother was driving a 2010 Mazda 6 and heading north on State Route 132, traveling with her older son and her two nine-year-old twins in the car. A 52-year-old woman, driving a 2010 Chevy Camaro and heading west, struck the Mazda with great force at the intersection of State Route 132 and 749/Lindale Nicholsville Road
Several business owners told the media that the intersection in question is one of the worst in the area. There, excessive speed and limited visibility for drivers has resulted in numerous wrecks. Many have been hoping for a turning lane and/or a reduced speed limit for years.
Road conditions on the day of the crash were clear and dry. A witness to the crash said she did not hear any indications that brakes were applied prior to the collision – just the haunting sounds of a major crash. Although first responders were able to airlift the boy to the University of Cincinnati Medical Center, he died enroute.
Police are asking local businesses for their surveillance tapes to determine who was at fault for the crash.
“In cases such as this one, negligence does play a part in the determination of fault. However, there is also another factor to be considered – the safety of the road at that juncture – a responsibility of TxDOT. It is possible that if the mother of the young boy who died decides to file a wrongful death lawsuit, there may be more than one named defendant,” suggested Schuelke.
