Holidays Tend to Result in Multiple Boating Accidents and Deaths
Aug 19, 2015
Austin, TX (Law Firm Newswire) August 19, 2015 – Never are the highways and byways of Texas more crowded with traffic than on a long weekend. When the weather is nice, boating is a pleasurable pastime, but it may become a deadly one.
The July 4th long weekend ended with Texas Game Wardens investigating several fatalities involving watercraft accidents. Watercrafts are designed to be ridden on the water and may be anything ranging from a canoe to a jet ski.
Late that Saturday, a Marble Falls Police Department marine safety patrol boat was patrolling the area when James Fry, 41, ran into the vessel. The police captain onboard sustained serious injuries. The boat driver was arrested with intoxication assault charges, a third-degree felony that may be elevated to a second-degree felony, as the captain was on duty at the time of the accident.
Houston County logged four fatalities involving a rented canoe. It is unclear what happened in that incident other than the canoe the family was in capsized. Three of the victims were recovered late that Sunday afternoon, and the game wardens were unable to recover the fourth victim until Monday. Witnesses told police they saw the family in the canoe and noted that the child was wearing a life preserver.
When the four did not return to the marina, a search located them shortly after it was launched. Three of the four preservers were floating on the water. The fourth was found on the child, but police suspect it was not fitted properly.
A five-year-old girl also died on the July 4th long weekend on Lake Travis, near Austin. Two sisters were being towed behind a boat while they rode on a tube hooked to a metal ski pole that was hooked into the boat by another metal pole. Investigators say a large wave hit the boat, detaching the ski pole, which hit the five-year-old in the back of the head. Although she was airlifted to Dell Children’s Medical Center, she was pronounced dead on arrival.
It was a busy weekend that also saw law enforcement dealing with nine boating accidents, nine search and rescues events, multiple felony arrests and the recovery of two stolen boats. 63 arrests were made for boating while under the influence.
“Yes, boating can be fun, but like driving a car, you need to drive responsibly. Drinking and driving a boat is likely to result in an accident. Not being properly prepared for a trip on a watercraft may also put your life at risk. If you don’t know what you are doing, have no training and no experience, stay on the shore,” said Austin personal injury attorney Bobby Lee, who has experience dealing with watercraft accidents. “If you have been in a boating accident, we are able to help you recover compensation for your injuries.”

- Driver with a BAC of .23 kills five
Efraim Carmona pled guilty to five counts of intoxication manslaughter after causing the accident that killed five people in June 2014. Although he could have received a 110-year sentence, he was instead handed a 50-year jail term. 34-year-old Carmona must serve 25 years before he may be considered for parole. He had been driving with a blood alcohol content of .23, about triple the legal limit for driving, and refused to cooperate with police after they arrived on the scene. Multiple cases of beer were discovered in his truck. The accident occurred when Carmona, driving east in a westbound lane, […] - Driverless cars: A boon or a bust?
It depends on whom you talk to or what you read as to whether you think driverless cars are a boon or a bust. Like many other things in this world, driverless cars have their pros and cons. Many think driverless cars are an accident looking for a place to happen. Others say the technology will save lives. Indeed it may, but there are other considerations on the table as well that you may not have read about in the media. For instance, Google’s driverless cars have been involved in at least 11 minor accidents. Google insists the cars were […] - It’s a no brainer that distracted driving is a major safety issue
Texting, surfing, emailing, using social media and video chatting are the leading causes of serious and fatal crashes for teens and adults. Laws abound in most states to ban the practice of using electronic mobile devices while driving, but in these states, such bans seem not to be effective. It is a conundrum. States without texting while driving laws say their accident rate is holding steady, while states with such laws say their accident rate is increasing. What is the answer to getting drivers to stop using mobile devices while behind the wheel? There are a number of new applications […] - Jet ski accident leaves college student dead
On June 6, 20-year-old Manuel Rivas and a fellow student, 19-year-old Natalie Valles, were kayaking on Lake Nasworthy in San Angelo, Texas, when a jet ski collided into them. Valles was recovered fairly quickly from the lake and taken to a nearby hospital for medical care for her head injury. She was released later the same day. Rivas was not found until the following afternoon. The jet ski driver, also a resident of San Angelo, did not sustain any injuries in the crash. According to the police report, he said he had been heading into the setting sun, and due […] - Motorcyclist dies in FedEx truck collision
It was just before 10 a.m. when a motorcyclist, heading down 10th Street near Q Avenue in Texas Township, Michigan, crashed into a FedEx truck that had pulled into his path. The 36-year-old rider was unable to change his trajectory, and struck the driver’s side of the truck. The biker was later pronounced dead on the scene. Police reports indicate that the rider was not wearing a helmet. The FedEx truck, driven by a 34-year-old Kalamazoo woman, was heading northbound on 10th Street. She had stopped at the Q Avenue intersection before proceeding, but did not see the motorcycle. The […]
