New Drunk Driving Law Goes Into Effect in Texas for First Time Offenders

Austin, TX (Law Firm Newswire) October 15, 2015 – Texas has a new drunk driving law that may affect first time DUI offenders by giving them the option to install an ignition interlock system in their vehicle. Even though it is an optional choice for those drivers, many feel it is still a step in the right direction to reduce drunk driving.

Ignition interlock systems require the driver to blow into the device before they can start their vehicle. This new law also mandates that the convicted offender absorb the cost of the device and its installation. Those convicted of DUI with a blood alcohol content of less than 0.15 percent may be able to drive if they have an ignition interlock system installed in their car. Previously, those drivers would get a license suspension and would often still drive, even when suspended.

According to a recent federal report, authored by the government, 40 percent of all deaths on the roads in Texas are the result of drunk drivers. In fact, Texas leads the nation in the number of drunk driving deaths, with a staggering total of 1,300.

Many proponents of harsher punishments for drunk drivers feel the new law will save lives by addressing the problem of drinking and driving before it has a chance to escalate. Those suggesting the law is too judgmental do not always take into consideration the high number of repeat offenders on the roads, many of whom have been involved in numerous collisions and may have seriously injured or killed someone.

“Despite the new law, many Texas plaintiff’s DUI attorneys realize that people will continue to drink and drive,” said Austin DUI attorney Bobby Lee of Lee, Gober & Reyna. While they express hope that this new law helps reduce the number of drinking and driving accidents, injuries and deaths, they realize that for the new law to be truly successful, people have to want to voluntarily stop driving while under the influence. “That is not always possible for some individuals and that is why plaintiff’s DUI counsel continues to be the voice of those injured in collisions involving drunk drivers,” Lee said.
