Lawsuit Filed Two Years After Deadly Accident Reports Petrillo and Goldberg, New Jersey

Pennsauken, NJ (Law Firm Newswire) December 16, 2015 – On Oct. 30, 2013, a 14-year-old girl was involved in a fatal car accident in Vineland, New Jersey. She was hit while crossing a street close to her bus stop. Her brother and sister witnessed the accident, and the girl died later that day.
Her father recently filed a claim on behalf of his daughter’s estate and her two siblings. The defendants in the lawsuit are the other parties to the accident, the Vineland Board of Education, City of Vineland and Cumberland County. The accident occurred at approximately 6:50 a.m. on Main Road. When the girl was crossing the street, she was struck by a vehicle operated by Norberto Rodriguez-Centro, and was struck again by a car operated by Marthenia Gaymon. The suit names the two motorists and the owner of one of the vehicles.
“In motor vehicle accidents, there can be a number of parties liable for causing injury to the victim,” said prominent New Jersey personal injury attorneys Petrillo & Goldberg. “Those who are responsible for creating policies may also be at fault for allowing certain conditions to exist that would encourage deadly accidents to occur.”
According to the lawsuit, the girl’s death was brought about by the motorists’ negligence and that of the board of education, city and county. The lawsuit alleges that the Vineland Board of Education has a duty to ensure the safety of students, and it had guidelines that called for students to cross very busy streets in order to reach bus stops.
The suit goes on to say that the Vineland Board of Education was aware, or should have been aware, that having a policy that required children to cross streets marked by heavy traffic at times when it was dark would endanger the lives of children, and could potentially lead to severe injury or death. Furthermore, the suit alleges that the city of Vineland and Cumberland County are liable for failing to fix the perilous intersection.
Daniel Strittmater, the father of the deceased, is asking for a jury trial, and is seeking damages and attorneys’ fees.
