Debi Chalik describes Erb’s Palsy as an injury to the nerves in the cervical spine or neck area, which is also known as the brachial plexus. At birth, those nerves are torn or stretched, and cause permanent paralysis in a child’s arm or hand.
The condition most frequently occurs in children at birth, and can have devastating effects, resulting in a long-term injury. The condition is caused by the obstetrician or delivering practitioner pulling on the baby’s head and neck to get the baby out. The obstetrician pulls so hard that a traction injury results. It normally occurs because the baby is too large to pass through the mother’s pelvic canal naturally. In the cases seen by Chalik & Chalik Law Offices, the mother should have been offered a Caesarean section prior to even trying a vaginal delivery. Or, upon realizing that this was going to be a difficult delivery, the obstetrician should have offered the mother a Caesarean section during labor.
When the babies are too large, they become stuck, and encounter a shoulder dystocia, in which the baby’s shoulder is lodged under the mother’s pelvic bone. The doctor then yanks the baby in order to get him or her out, and stretches the nerves, thereby causing permanent nerve damage in the baby’s arm and hand. As a result, the baby requires a great deal of long-term care.
