Prominent New York Criminal Defense Attorney Comments on What to Do If the Police Want to Talk

Oct 14, 2016

New York, NY(Law Firm Newswire) October 14, 2016 – A situation that most people are unfamiliar with and unprepared for, a New York police detective wants to talk to them. According to a prominent New York criminal defense attorney, far too many people are lulled into a false sense of security in this situation and end up revealing something that leads to their arrest.

“While most people are aware that if they are arrested they should not talk to police and should ask for a lawyer, most people don’t know what to do if they are not under arrest but the police want to question them,” said Peter Brill, of Brill Legal Group. “The short answer is that walking into a police interview without legal representation is a big mistake.”

Brill Legal Group has published an online guide, “Do the Police Want to Talk to You?” that outlines why agreeing to be questioned by the police without a lawyer present is a bad idea.

According to Brill, people often agree to speak to police because they have an alibi, they have done nothing wrong, or they sincerely want to help the police solve a crime. However, police interrogation tactics can lead people to say incriminating things. Police interrogators know that people have a natural desire to please others, and they use this to get individuals to say things they should not reveal, or even admit to things they did not do.

“The bottom line is that unless you are the victim of a crime, the police are not trying to help you,” said Brill. “You should have a lawyer present to protect your rights.”

Brill says that if a person really is just a witness to a crime and wants to assist the police, then they should think of having an attorney present as an insurance policy, and that it is better to be safe than sorry.

“People wonder if bringing a lawyer makes them look guilty,” said Brill. “I say no, it makes you look smart.”
