Impact of US Vaginal Mesh Kit Lawsuits Going Global

Austin, TX (Law Firm Newswire) November 23, 2016 – The vaginal mesh kit fiasco is now making headlines around the world thanks to two dedicated Texas trial attorneys, Steve and Amber Mostyn of Mostyn Law, who took their surgical mesh research to Scotland’s Parliament.

Mostyn Law’s founders presented their research to Scottish Parliament Member Neil Findlay to warn of the alleged dangers of vaginal mesh products. As a result of their visit, Findlay, who found the information, “deeply disturbing,” issued a call for an investigation into Boston Scientific Corporation’s (BSC) surgical mesh devices.

It was the Mostyn law firm that filed a Racketeering Influenced and Corrupt Organizations Act (RICO) lawsuit in West Virginia in January 2016 alleging BSC was using counterfeit plastic resin from China in their vaginal mesh implants – a factor that contributed to painful complications for patients.

“Mr. Mostyn showed the Scottish Parliament internal emails that laid out BSC’s global search for a Chinese plastic resin supplier just after the U.S. maker said the material should not be used in the human body and stopped selling it for that specific use,” outlined Bobby Lee, a Texas vaginal mesh litigator with Lee, Gober & Reyna in Austin, Texas. Mesh lawsuits against BSC and other mesh makers have been filed across the United States and many of those cases have resulted in multi-million dollar verdicts.

The Mostyn’s took their case for justice for women harmed by counterfeit surgical mesh kits to Scotland because it offered more evidence that Boston Scientific’s product harmed women worldwide and was not specific to the U.S. The dangers associated with the kits pose a serious risk to women in every country where the kits are offered, as part of treatment for pelvic organ prolapse (POP) and stress urinary incontinence (SUI).

Emails discovered by Mr. Mostyn, combined with other corroborating information, showed that BSC allegedly smuggled 37,000 pounds of synthetic resin into the United States from China in 2011 and 2012. The company did not get approval from the Food and Drug Administration (FDA) for the material.

Thanks to the Mostyn’s for taking their case experience to Scotland, the Scottish government has suspended the use of the implants and is calling for an independent safety review. Over 400 cases relating to surgical vaginal mesh implant kits have been filed in Scottish courts.
