Impact of US Vaginal Mesh Kit Lawsuits Going Global
Nov 23, 2016
Austin, TX (Law Firm Newswire) November 23, 2016 – The vaginal mesh kit fiasco is now making headlines around the world thanks to two dedicated Texas trial attorneys, Steve and Amber Mostyn of Mostyn Law, who took their surgical mesh research to Scotland’s Parliament.
Mostyn Law’s founders presented their research to Scottish Parliament Member Neil Findlay to warn of the alleged dangers of vaginal mesh products. As a result of their visit, Findlay, who found the information, “deeply disturbing,” issued a call for an investigation into Boston Scientific Corporation’s (BSC) surgical mesh devices.
It was the Mostyn law firm that filed a Racketeering Influenced and Corrupt Organizations Act (RICO) lawsuit in West Virginia in January 2016 alleging BSC was using counterfeit plastic resin from China in their vaginal mesh implants – a factor that contributed to painful complications for patients.
“Mr. Mostyn showed the Scottish Parliament internal emails that laid out BSC’s global search for a Chinese plastic resin supplier just after the U.S. maker said the material should not be used in the human body and stopped selling it for that specific use,” outlined Bobby Lee, a Texas vaginal mesh litigator with Lee, Gober & Reyna in Austin, Texas. Mesh lawsuits against BSC and other mesh makers have been filed across the United States and many of those cases have resulted in multi-million dollar verdicts.
The Mostyn’s took their case for justice for women harmed by counterfeit surgical mesh kits to Scotland because it offered more evidence that Boston Scientific’s product harmed women worldwide and was not specific to the U.S. The dangers associated with the kits pose a serious risk to women in every country where the kits are offered, as part of treatment for pelvic organ prolapse (POP) and stress urinary incontinence (SUI).
Emails discovered by Mr. Mostyn, combined with other corroborating information, showed that BSC allegedly smuggled 37,000 pounds of synthetic resin into the United States from China in 2011 and 2012. The company did not get approval from the Food and Drug Administration (FDA) for the material.
Thanks to the Mostyn’s for taking their case experience to Scotland, the Scottish government has suspended the use of the implants and is calling for an independent safety review. Over 400 cases relating to surgical vaginal mesh implant kits have been filed in Scottish courts.
“Our office is quite familiar with vaginal mesh implants and if you are experiencing pain and stress as a result of such surgery, our door is open to you,” Lee added.

- The futuristic BMW motorcycle — too good to be true
BMW, long considered to be a forward thinking auto manufacturer, has now come up with a vision for the future of a safer, zero-emissions motorcycle. The company promises a future with no accidents where helmets will not be necessary. A zero-emission, no helmet and no accident motorcycle is not only futuristic and misleading, but likely far-fetched. The company’s future vision is suggesting their Motorrad VISION NEXT 100 is a self-balancing motorcycle that works in co-operation with a reality headset that offers riders navigational information, speed feedback and integrated rear-view mirrors and a superior view of the road they are traveling. […] - Passengers are just as distracting as e-devices
Many drivers understand that e-devices in cars are distracting and may also be deadly. However, according to studies done by the National Safety Council (NSC) and the National Highway Traffic Safety Administration (NHTSA) talking to passengers in the vehicle is another major risk factor. Figures just released by the Centers for Disease Control and Prevention (CDC) show that more than eight people are killed daily and an estimated 1,161 are injured due to distracted driving. The CDC lists three main categories of driving distractions: taking eyes off the road (visual) taking hands off the wheel (manual) taking the mind off […] - Local Texas governments pass texting while driving bans as no state law in place
College Station, Texas has taken a stand against texting while driving in light of the fact that there are no state laws in place in the state. Texas has so far not steadfastly brought in legislation to address texting while driving. Interestingly, the new ordinance also applies to cyclists. In College Station, the recently passed law that goes into effect November 9, 2016, bans virtually all use of hand-held cellphones and other forms of wireless communications while driving. Some exceptions to the new legislation exist that allow the use of e-devices while fully stopped or calling for emergency help. One […] - Vaginal mesh implant lawsuits continue to be filed
Kentucky’s attorney general just recently filed a lawsuit in Franklin Circuit Court against Johnson & Johnson (J & J) and their medical device subsidiary. It alleges deceptive marketing of vaginal mesh implants according to the state’s consumer protection act. Over 15,000 women in Kentucky received vaginal mesh implants. Allegedly, the company told doctors their mesh kits had been approved by the FDA. However, they had only been cleared. Kentucky is not the only state filing a lawsuit against J & J. California and Washington have also filed suits for similar reasons. The lawsuit alleges that J&J deliberately withheld vital information […] - Bars may be held responsible for serving customers who DWI
