Wrongful Death Lawsuit Filed Against Texas, Ford Dealership

Austin, TX (Law Firm Newswire) March 8, 2018 – A deadly accident in the parking lot of a Ford dealership, in Texas, has resulted in a wrongful death lawsuit. The lawsuit is seeking more than $1 million in compensation.
The victim was in the parking lot of a Ford dealership in Waco, Texas. He was struck and dragged by a 2017 Expedition, being driven by a salesperson, backing up “at a high rate of speed.” The victim’s family filed a wrongful death lawsuit against the driver and the dealership citing negligence as the cause of the fatal accident.
The victim was at the dealership for maintenance on his vehicle, a 2010 Ford Escape. After dropping his car off, the man decided to look around the lot at the new vehicles. That is when the accident happened.
The man was dragged more than 20 feet and the accident reconstruction report revealed the salesperson was doing more than 22 mph in reverse and thus was not backing up safely. The police department determined the driver was at fault for the accident. The victim was taken to hospital, but died 11 days later.
Parking lots are notoriously dangerous, but the conduct at this Ford dealership lot created additional problems. The risk of harm to customers on this dealership’s premises was a reality every day. In particular the practice of backing up numerous vehicles down aisles from one location to another was a dangerous procedure allowed by management.

However, during the last 100 years, federal and state courts have instituted the right to bring a wrongful death action. Today, every state has a wrongful death law that is applicable in all fatal accidents such as car accidents, medical malpractice lawsuits, product liability cases, and other accidents that negligently claim someone’s life.
