Medical Malpractice Lawsuit Results in 18.4 Million Dollar Award

Southfield, MI (Law Firm Newswire) August 14, 2018 – A federal jury awarded a Massachusetts man $18.4 million in a medical malpractice lawsuit when a clinic did not test him for HIV.
The plaintiff, a gay man, was already at a high risk for exposure to HIV, but as a former paramedic, the risks were even greater. Paramedics are routinely exposed to bodily fluids such as blood.
According to court documents, the man went to a local hospital in 2007 after experiencing facial paralysis. He had agreed to be tested for HIV when an intern told him his symptoms were consistent with an HIV infection. Yet, despite signing the consent forms, the neurologist felt the man was at no risk of HIV and cancelled the test. The patient was not informed of this decision.
A month later, the man was told his tests showed no problems. At that time, he believed those results included an HIV test. Another physician detected HIV three years later. By then, he had AIDS, which caused cognitive impairment and brain damage. He sued the hospital and doctors who had initially cared for him. A jury found the defendant’s negligence was the direct cause of plaintiff’s injuries.
