CCA Announces Big Moves in December 2019

Los Angeles, CA (Law Firm Newswire) December 13, 2019 – Los Angeles based lemon law firm, California Consumer Attorneys, P.C. (“CCA”) announced today that its partner, Michael H. Rosenstein, earned one of the largest California Lemon Law verdicts of the year. CCA also announced the move of its Los Angeles headquarters from Century City, California to Westwood, California. CCA’s founding partner, Michael H. Rosenstein, served as lead trial counsel in the matter Newton v. BMW North America, which was tried in Los Angeles Superior Court before the Honorable Daniel P. Murphy. On December 11, 2019, a unanimous jury of 12 rendered a verdict in plaintiff’s favor of $294,998. Mr. Rosenstein commented on the verdict, stating, “I was humbled to represent Mr. Newton in this important case. Mr. Newton was a 20-year veteran of the United States Navy who continues to work for the United States Military. It was truly an honor to serve as trial counsel for somebody who had served our country for so many decades. Also, we were extremely gratified that the jury saw through BMW’s smoke and mirrors and affirmed Mr. Newton’s contentions that his vehicle was defective and unfixable.”
The Newton matter concerns a 2012 BMW 750 iL, which was equipped with BMW’s beleaguered N63 V8 twin-turbo engine. Mr. Newton had purchased the flagship “Ultimate Driving Machine” hoping for years of reliable use, safe driving, and luxurious motoring. However, the vehicle developed a series of troubling and serious defects arising from the N63 engine. Mr. Newton’s N63 engine excessively consumed oil, leaked oil, shuddered and jerked, and numerous critical engine parts (including the entire short block) had to be replaced. Mr. Rosenstein commented after the trial, “This was clearly a case where BMW refused to do right by its customer. Mr. Newton contacted BMW directly before hiring attorneys and requested that they buy his car back voluntarily; but they refused to do so. Throughout the litigation, BMW continued to strong arm Mr. Newton and refused to make a reasonable settlement offer prior to the start of trial. In fact, their highest offer prior to trial was $20,000, which is less than 7% of the verdict ultimately rendered by the jury. Obviously, BMW’s cynical math was proven incorrect.”
Mr. Rosenstein furthermore said that, “It is also important to keep in mind that we will be bringing a separate motion for our attorneys’ fees and costs, which we expect will be awarded in full by the court. Here, in addition to the nearly $300,000 verdict, all of Mr. Newton’s attorneys’ fees and costs will be paid by BMW.” According to a review of 2019 Lemon Law verdicts published by Thompson-Reuters/Westlaw this year, Mr. Rosenstein’s verdict is one of the highest Lemon Law verdicts in the State of California this year.
CCA also announced moving and expanding its headquarters to 10900 Wilshire Boulevard in Westwood, California.
