Tractor Trailer Rear Ends Car Resulting in an Underride Accident Killing Three
Mar 4, 2020
Austin, TX (Law Firm Newswire) March 4, 2020 – A semi-truck rear-ended a family car, sending it under the backend of another tractor-trailer. Three people were killed.
Underride accidents are dangerous and rarely see survivors. The underride guards, installed on most trucks, are meant to prevent cars from sliding under trucks. Unfortunately, most underride guards rarely hold up in a crash.
The family members involved in this wreck were on their way to a family event when a semi-truck rear-ended their vehicle. The force of the impact drove the family’s car into the back of another semi. Unfortunately, the underride guard did not prevent the car from sliding under the truck.
According to the trucking industry, which does not keep statistics relating to underride accidents, over 200 people die each year in these types of crashes. Despite the evident failure of underride guard rails, the industry has yet to do anything to strengthen the guards.
Fortunately, tighter regulations are on the horizon. Included in the 2020 transportation funding bill are some more stringent standards on rear guard rails.
The aftermath of a trucking accident can haunt families for years, and often the only recourse they have is to file a wrongful death or a personal injury lawsuit. Neither of those legal actions can undo what happened, but both can go a long way toward helping those involved to heal and move on.
“In Texas, wrongful death is when an individual is killed as a result of the negligence or intentional act of another,” says Austin wrongful death attorney, Brooks Schuelke. Death may be the result of logging accidents, construction accidents, car crashes, medical malpractice, farming accidents and tractor-trailer, trucking accidents.
“Wrongful death claims come under the Texas wrongful death statute that also offers a way for victim’s survivors to receive compensation for the emotional and financial loss of a loved one,” added Schuelke.
One of the most important parts of a wrongful death claim is the ability to hold a company, person, or other entity or entities responsible or liable for the conduct that caused a death. The successful resolution of a wrongful death lawsuit can also send a clear message to others that such behavior that resulted in death should not happen again. The compensation in a wrongful death lawsuit helps the family deal with their financial losses, slowly heal and move forward.
“If you or a friend or family member have been involved in a trucking accident, please give us a call and discuss your case. We can outline your legal rights and what to expect if you choose to file a lawsuit,” Schuelke said.
