One Dead, Two Taken to Hospital in Serious Condition
Nov 1, 2021
Austin, TX (Law Firm Newswire) November 1, 2021 – Recently, a two-vehicle head-on collision in Cherokee County took the life of a 68-year-old Texas woman and injured two others.
The head-on collision occurred when a 2007 Dodge Durango driver crossed over into the westbound lane of U.S. Highway 175, near Cuney. The Durango hit a 2007 Ford Fiesta. One passenger in the Fiesta was pronounced dead at the scene, and the driver and one other passenger were taken to the nearest medical facility for treatment. The Durango driver was transported to Jacksonville for medical care.
This accident is still under investigation.
Head-on collisions are the most deadly and dangerous accidents on the roadways. In most cases, they result from a driver losing control of their vehicle. Drivers can lose control of their automobile for several reasons: driving while distracted, driving while fatigued, driving while impaired by drugs or alcohol, or speeding and losing control.
In this case, one individual lost their life, leaving behind a grieving family. “At Schuelke Law, we understand what it means to lose someone you love suddenly and try to deal with the reality that they are gone,” said Austin wrongful death lawyer Brooks Schuelke, not involved in this case. “We can help you by guiding you through a wrongful death case and seek compensation for medical expenses, funeral and burial costs, and your other losses.”
Vehicle crashes typically involve several insurance companies, and a skilled wrongful death attorney can help a plaintiff deal with them. Insurance companies only care about their bottom line and will stop at nothing to have you settle quickly for as little as possible.
“At one time, spouses, children and parents of someone killed in an accident were not able to sue for damages in a loved one’s death. The Wrongful Death Act created an action allowing plaintiffs to file a claim for actual damages for the death of a loved one,” Schuelke explained. A wrongful death claim permits those left behind to recover compensation in the wake of someone causing the death of their family member.
Actual damages in a wrongful death claim may include:
Mental anguish, which refers to the emotional pain and suffering from the death of a family member.
Loss of financial security, such as losing the deceased’s earning capacity, the value of their advice, services, and care.
Loss of inheritance, meaning what the deceased family member would have left to another family member had they lived a normal life span.
Loss of companionship benefits, including love, comfort, and society.
There are instances where exemplary damages can be recovered in a wrongful death claim if the individual’s death was caused by a willful omission or act or gross negligence.
“If you have any questions about filing a wrongful death claim, I am here to help,” said Schuelke.
