Inadequate Big Rig Cab Survival Space Allegedly Suffocates Truck Driver

Southfield, MI (Law Firm Newswire) October 5, 2015 – Geoffery Parker died in a horrific big rig crash in 2014. The cab survival space was allegedly too small and the cab was not adequately designed to withstand a rollover, and he suffocated.
At the time of the accident, Parker was driving a blue 2012 Peterbilt, a Paccar built product. He was headed south on U.S. Highway 69 when a bull appeared in his travel lane. The truck hit the animal, causing the trailer and truck to jackknife and separate.
The cab rolled onto the roof, crushing the driver’s compartment. Parker was wearing a seatbelt, but the cab’s survival space experienced “severe intrusion” and lacked breathing space after having been crushed, and he suffocated.
Parker’s family filed a wrongful death lawsuit against Paccar Inc., based in Washington, alleging the cab design and manufacturing of the vehicle were insufficient. They further allege defective manufacturing of the big rig due to an inadequate rollover protection system, negligence, strict liability and gross negligence. “The plaintiffs are further seeking compensation for loss of companionship, pecuniary loss and emotional distress,” said Litigation Funding representative, Daren Monroe.
