Austin, TX (Law Firm Newswire) May 6, 2020 – Austin, Texas has an unenviable record for ranking as the 18th worst city in the United States in terms of traffic accidents. The latest accident took the life of a nine-year-old girl.

Recently, a child was seriously injured, requiring emergency surgery for critical injuries, and another died at the hospital after a crash in the 5500 block of E. Parmer Lane. At about 9:18 p.m. 34-year-old Cain Estrada was involved in a crash.

This collision is Austin’s 24th fatal traffic accident of 2020 and the 25th total vehicle fatality of the year. Last year at this time, there were 17 traffic fatalities, according to the Austin Police Department.

The police report indicated a 2009 Hummer H3 was heading southbound, when the driver failed to yield to Estrada’s Mercedes-Benz. The Mercedes-Benz hit the passenger’s side of the Hummer. Two children were transported to hospital.

Estrada was sent to a local hospital to receive treatment for non-life-threatening injuries. Later that day, he was arrested for DWI, which police believe may have been a contributing factor in the collision.

“Even though the victim in this collision is likely aware of having legal rights, it would be best to reach out to an experienced car accident attorney to find out precisely what those legal rights are,” explained Austin car accident attorney, Brooks Schuelke, who is not involved in this case.

It is important to keep in mind, that after any car accident, talking to the other driver’s insurance is not recommended. Too often, insurance companies take an injured person’s statements out of context to either diminish the injured person’s injuries or improperly put blame for the wreck on the injured person.

“Do not take any money from the other driver’s insurance company or sign any forms. There is a chance you would lose the ability to sue for damages since those forms almost always mean you relinquish your legal rights,” said Schuelke. “Insurance companies would love for you to give up your rights before you know how bad you’re hurt or before you have talked to an attorney to know what rights you have.”

Insurance companies intend to reduce any claims that are filed in order to protect their company’s bottom line. It is important to be aware of that.

It is best to have legal representation when attempting to file a car accident claim. “At Schuelke Law we do not take a backseat to insurance companies and our final leverage for a client is that if the insurance company does not want to offer a fair settlement, then we can take the case to court. Let me know how I may be of service to you,” said Schuelke.
