Lawsuit Filed Against Illinois Nursing Home After Leg Amputation

Chicago, IL (Law Firm Newswire) July 10, 2013 – An Illinois man is suing a nursing home, claiming substandard care led to part of his leg being amputated.
John Eric Rush has filed suit against Hillcrest Nursing and Rehabilitation Center, located in Joliet, Illinois. Rush claims that the nursing home provided negligent care that caused deterioration in his health and made it necessary for part of his leg to be amputated. The lawsuit was filed in Cook County Circuit Court.
“Nursing home neglect and abuse is a growing problem,” said Paul Greenberg, a Chicago nursing home abuse attorney not involved in the case. “When someone is victimized, a lawsuit can result in compensation for injuries suffered.”
According to the lawsuit, Rush became a resident of Hillcrest in 2010, after he suffered several strokes and was partially paralyzed. Rush was unable to speak but could walk with supervision and the use of a walker.
The lawsuit alleges that over the next year Rush developed several bed sores and a pressure sore on his left foot. That sore developed an infection, and as a result his left leg had to be partially amputated. According to the lawsuit, Rush’s condition was caused by negligent care. Rush, 49, has since moved from Hillcrest.
This is not the first time Hillcrest Nursing and Rehabilitation Center has been accused of substandard care. The facility reportedly lost Medicaid and Medicare funding as a result of both the federal and state governments determining that the nursing home could not provide residents with a minimum standard of care. In addition, the Illinois Department of Public Health fined the facility more than $30,000. An investigation found a minimum of 23 reports of abuse against residents during a five-month-long period in 2011. In 2012, the Department of Public Health took action to revoke the facility’s license after two suspicious deaths occurred there over a period of six months.
According to Rush’s attorney, he should have been moved regularly to prevent pressure sores from forming, and the sore on his foot would not have become infected if he had received proper care.
