Hit-and-Run Driver Leaves Father of Two Dead

Dec 9, 2014

Southfield, MI (Law Firm Newswire) December 9 , 2014 – A hit-and-run driver was apprehended less than an hour after fleeing the scene of a fatal accident.

“Donald Mooney of Port Washington merely stepped away from his job as a dispatcher to get a cup of coffee across the street from where he worked. A 2010 Ford Fusion hit him on the way to the coffee shop. The driver of that vehicle, 34-year-old Cosmin Florea, was later apprehended by police,” explained Daren Monroe, Litigation Funding Corporation representative. Although Mr. Mooney made it to the hospital alive, he died while in care.

When police found the driver’s vehicle at Winchester Boulevard and Braddock Avenue in Queens, it had extensive front-end and windshield damage. The driver was arrested and charged with DWI, second-degree vehicular manslaughter and leaving the scene of a fatality.

Mooney had been working two jobs in order to help his 18-year-old daughter with university expenses.

“Funeral and burial expenses and the loss of income, companionship and nurturing of a father cannot be replaced or easily recovered from,” said Monroe. The family may choose to file a wrongful death lawsuit to seek compensation for their loss and some form of closure, as well as to send a message that drinking and driving kills.

Litigation funding would be worth investigating. Such funding offers plaintiffs an emergency lawsuit loan that allows them to get back on their feet financially, deal with immediate and pressing expenses, and retain funds for other regular bills that occur while waiting for trial.

“The plaintiff applying for pre-settlement funding just needs to hire an attorney and then call us with the details of the case, including the expected jury award that may result at the end of a trial. This figure is usually calculated by the attorney-of-record,” Monroe outlined.

A lawsuit loan applicant does not need to be employed when they apply for help, is not expected to pay any money upfront, is not required to go through a credit check and does not have to repay the loan should the case be lost in court. Cash-strapped plaintiffs often find this kind of assistance helpful, as it allows them to get on with their lives and ignore insurance companies asking them to settle for pennies on the dollar.
